TERMS & CONDITIONS

Ion’s Driving School Ltd
Effective date: 01/12/2025

Version: v1.0

These Terms & Conditions form the basis of the agreement between Ion’s Driving School Ltd (“we”, “us”, “our”) and the student (“you”, “your”). By booking lessons, creating an online account, or purchasing lesson packages, you agree to these Terms & Conditions and to our separate Cancellation Policy, which is incorporated by reference.

If you do not agree with any part of these Terms, you must not use our services.

1. Services Provided

1.1 We provide driving tuition in manual vehicles within the areas we operate, primarily NN1 to NN7.
1.2 Standard lessons are 2 hours, unless otherwise agreed, such as motorway lessons, refresher sessions, or test-day bookings.
1.3 Mock tests may be delivered as part of your normal lesson time at the instructor’s discretion.
1.4 Driving test car hire is available only to students who have taken sufficient lessons with us. We do not hire our vehicles to learners we have not personally trained.

2. Booking Lessons

2.1 Lessons must be booked online through our website or arranged directly with the instructor.
2.2 You must provide correct pickup and drop-off locations when booking.
2.3 Pickup locations must be within our operating area.
2.4 If you change your pickup location after booking and this results in additional travel time, your lesson may be shortened while your instructor drives to the new location.
2.5 If you fail to provide a pickup address at least 48 hours before the lesson, we reserve the right to shorten or cancel the session without refund.

3. Student Requirements

3.1 You must be at least the legal minimum age to drive in the UK. Any booking made by someone who does not meet the legal age requirement will be cancelled.

3.2 You must hold a valid driving licence and provide the required DVLA driving licence check code before your first lesson.
3.3 You must be fit to drive. You must not attend lessons under the influence of alcohol, drugs, medication that impairs your ability, or while knowingly unfit to drive.
3.4 If the instructor believes you are unfit or unsafe, the lesson will be terminated immediately with no refund.
3.5 You must inform the instructor of any medical conditions, eyesight requirements, or circumstances that may affect your driving.

4. Payment and Pricing

4.1 Payment is required at the time of booking unless agreed otherwise (e.g., BACS payment in exceptional circumstances).
4.2 Prices are shown on our website and may change at any time.
4.3 No part of a lesson will take place until the full payment for that lesson is received.
4.4 Bulk packages (such as 6-hour or 10-hour bundles) provide discounted rates. You may request a refund of unused hours, but any used hours will be recalculated at the standard 2-hour lesson price, not at the discounted package rate. (Example: If a 10-hour package is purchased and only 4 hours are used, you will be refunded the package price minus the full standard rate for the 4 hours taken. This prevents abuse of discounted bundles.)

4.5 All discount codes, vouchers and promotional offers are provided at our discretion and may be withdrawn, amended or discontinued at any time without notice. We reserve the right to withdraw, refuse or cancel any discount, and to cancel lessons booked using a discount, where misuse, duplication or abuse is suspected, including the creation of multiple accounts.

5. Cancellations, No-Shows and Rescheduling

5.1 The full cancellation rules are detailed in our Cancellation Policy, which forms part of these Terms.
5.2 Students must give 48 hours notice to cancel or reschedule a lesson.
5.3 Cancellations within 48 hours or failing to attend your lesson result in a full charge, with no refund.
5.4 We reserve the right to decline further bookings if a student repeatedly cancels, reschedules, or disrupts scheduling without reasonable cause.

5.5 If you arrive late, the lesson will still end at the scheduled time. Lost time due to lateness will not be refunded or added to future lessons.

5.6 Lessons may be postponed in unsafe weather conditions such as snow, ice or storms. We reserve the right to rearrange lessons if driving would be unsafe for you or the instructor.
5.7 If we need to cancel, we will give as much notice as reasonably possible, typically at least 24 hours, except in emergencies, illness, or vehicle issues.

5.8 We cannot guarantee availability of specific time slots or lesson days, and scheduling may vary due to operational constraints.

6. Lesson Conduct and Behaviour

6.1 You must follow reasonable instructions from your instructor at all times.
6.2 We reserve the right to end any lesson immediately if you behave in an abusive, aggressive, unsafe, or inappropriate manner. No refunds will be issued.
6.3 Recording lessons (audio or video) is not permitted unless the instructor gives explicit permission.

7. Vehicle Condition and Responsibility

7.1 Our tuition vehicles are maintained, insured, taxed, MOT-compliant and roadworthy at all times.
7.2 Our insurance covers tuition and supervised driving.
7.3 Students are not liable for insurance excess in the event of an accident during a lesson or test, unless the damage occurs due to deliberate misconduct, intentional misuse, or ignoring instructions.
7.4 In the rare event that our car becomes unavailable (breakdown, damage, or maintenance), we will rearrange your lesson or offer an alternative date.

8. Recording and Dashcam Usage

8.1 For safety, training and insurance purposes, our tuition vehicles are equipped with forward and rear-facing dashcams. These cameras record video and audio during lessons.
8.2 By taking lessons with us, you consent to being recorded inside and around the vehicle.
8.3 Recordings are used only for legitimate purposes, such as:

  • insurance claims.

  • incident investigation.

  • protecting the instructor and students.

  • monitoring unsafe driving situations.

  • verifying events if a dispute arises.

8.4 Dashcam footage is stored and retained only for as long as reasonably necessary for the purposes above, after which it is deleted.
8.5 Footage is not used for marketing, published, or shared with third parties except when required by:

  • our insurer.

  • the police.

  • legal authorities.

  • situations involving safety, crime, or liability.

8.6 Students are not permitted to request routine copies of recordings unless required by law or as part of an active investigation.

9. Driving Tests

9.1 Test-day use of the instructor’s car is available to students deemed ready by the instructor.
9.2 We reserve the right to refuse the car for a test if we believe doing so would be unsafe or inappropriate.
9.3 If the DVSA cancels your test, our Cancellation Policy applies to any associated lesson time.

10. Account Use and Online Access

10.1 You must create an account on our website to book and manage lessons.
10.2 You are responsible for keeping your login secure.
10.3 We reserve the right to suspend accounts that misuse the booking system, repeatedly cancel, book with no intent to attend, or behave abusively.

10.4 We may temporarily or permanently restrict access to your account if unauthorised or suspicious activity is detected.

11. Communications, Notifications and Reminders

11.1 By creating an account or booking a lesson, you agree to receive essential service communications from us by email, SMS and automated system notifications. These are mandatory for lesson delivery and include confirmations, reminders, cancellations, rescheduling notices, safety information and payment updates.
11.2 These communications are necessary for the efficient delivery of driving tuition and cannot be opted out of.
11.3 These messages are not marketing communications and are used solely to provide the services you have requested.
11.4 You may separately choose to opt in or opt out of any marketing communications, newsletters or promotional messages if we offer them in the future.
11.5 You are responsible for ensuring your contact details are accurate and kept up to date so you can receive necessary notifications.

12. Liability

12.1 We are not liable for loss, damage, or injury caused by circumstances outside our control, including traffic delays, road closures, weather, illness, DVSA cancellations, or third-party actions.

12.2 We are not liable for any loss arising from incorrect information you provide, such as wrong pickup addresses or failure to meet legal driving requirements.
12.2 Nothing in these Terms limits our liability for fraud, negligence, or matters where liability cannot be excluded by UK law.

13. Changes to These Terms

13.1 We may update these Terms from time to time.
13.2 Continued use of our services after changes are published constitutes acceptance of the updated Terms.
13.3 A revision history may be displayed at the top of this page.

14. Governing Law

14.1 These Terms are governed by the laws of England and Wales.
14.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
